Terms of Use

By downloading or using Soleil ("the App"), you agree to these End-User License Agreement ("EULA"). This EULA is a binding agreement between you ("End-User") and Pragmatiq ("Developer"), not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the App and its content.

1. Description of Service

Soleil is a lifestyle and wellness app that provides UV index information, sun safety guidance, sunscreen reminders, vitamin D estimates, and tanning guidance. It is available for iPhone and Apple Watch.

2. License

The Developer grants you a non-transferable, non-exclusive license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license does not allow you to use the App on any device you do not own or control. The terms of this EULA will govern any updates provided by the Developer that replace or supplement the original App, unless such update is accompanied by a separate license. You may also access and use the App through Apple's Family Sharing or volume purchasing programs.

3. Medical Disclaimer

Soleil is not a medical device and does not provide medical advice. This app is a lifestyle and wellness tool that provides general information about UV exposure, sun safety, and estimated vitamin D synthesis. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Important:

• UV index data and burn time estimates are approximations based on general models. Individual results vary significantly based on skin type, location, altitude, cloud cover, and environmental factors.
• Vitamin D estimates are based on published research models and should not be used as a substitute for blood tests or medical evaluation.
• Tanning guidance is provided to help reduce burn risk for users who choose to spend time in the sun. Soleil does not endorse or encourage tanning. Any UV exposure increases skin cancer risk.
• This app is not approved by the FDA, TGA, MHRA, or any medical regulatory agency.
• Always consult a qualified healthcare professional before making health decisions based on information from this app.

4. Subscriptions

Soleil offers premium features via auto-renewable subscriptions and a one-time lifetime purchase:

• Monthly: $2.99/month
• Yearly: $19.99/year (includes 7-day free trial)
• Lifetime: $49.99 (one-time purchase)

Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Manage subscriptions in Settings > Apple ID > Subscriptions.

5. Maintenance and Support

The Developer is solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. To the extent that any maintenance or support is required by applicable law, the Developer, not Apple, shall be obligated to furnish any such maintenance or support.

6. Warranty

The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the Developer's sole responsibility.

7. Product Claims

The Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

8. Intellectual Property

All content, design, and functionality of Soleil are owned by Pragmatiq and protected by intellectual property laws. The Developer, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any intellectual property infringement claim relating to the App.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOLEIL AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO SUNBURN, SKIN DAMAGE, VITAMIN D DEFICIENCY OR EXCESS, OR ANY OTHER HEALTH CONSEQUENCE.

YOUR USE OF UV DATA, BURN TIME ESTIMATES, VITAMIN D CALCULATIONS, AND TANNING GUIDANCE IS AT YOUR OWN RISK.

10. Export Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

11. Third-Party Terms

You must comply with applicable third-party terms of agreement when using the App. This includes, but is not limited to, your wireless data service agreement and any applicable Apple Media Services terms.

12. Data Attribution

UV and weather data is provided by Apple WeatherKit. Vitamin D estimates are based on published photobiology research (Holick MF, 2007).

13. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the app after changes constitutes acceptance.

14. Governing Law

These terms are governed by the laws of France.

15. Apple as Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
